BIR Withholding Tax On Philippine Salaries Is Somebody's Job. On A Direct Transfer It Is Nobody's.

BIR withholding tax on Philippine salaries is the employer’s obligation, not something the worker tidies up later. Revenue Regulations 11-2018, section 2.79(A), is one sentence long: every employer must withhold from compensation paid an amount computed in accordance with these Regulations. Compensation means an employment relationship, and the label on your agreement does not decide whether you have one. A genuinely self-employed contractor is taxed under a different regime.
So the question is not what you call your person in Manila. It is which regime the work sits in, and whether anybody operates either.
Outstaffer sells an employer of record that holds the employment, so treat that as a disclosure.
What the BIR table takes out of a Philippine salary
Annex E of RR 11-2018, the revised withholding tax table effective January 1, 2023 and onwards, sets six brackets. Compensation of ₱20,833 and below is withheld at nothing. From ₱33,333 to ₱66,666 the table prescribes ₱1,875.00 plus 20 per cent of the excess over ₱33,333. From ₱66,667 to ₱166,666 it is ₱8,541.80 plus 25 per cent over ₱66,667. The top bracket opens at ₱666,667.
How much is withheld on a salary of ₱80,000 a month?
₱11,875.05, where the arrangement is an employment one. The table gives ₱8,541.80, then 25 per cent of the ₱13,333 above the bracket floor, which is ₱3,333.25. Across a year that is ₱142,500.60. The person you believe you are paying ₱80,000 a month is on ₱68,124.95 a month. That is the table run straight, before mandatory contributions and the 13th month exemption.
In a direct arrangement no payroll applies it.
A transfer cannot be structured, and a payroll can
The withholding is only half of what a bank transfer skips. Revenue Regulations 29-2025, issued on 22 December 2025, further amends the de minimis provisions of RR 2-98 and lifts the ceilings on benefits exempt from income tax and fringe benefit tax. Rice subsidy ₱2,500 a month, laundry ₱400 a month, uniform and clothing ₱8,000 a year, actual medical assistance ₱12,000 a year, Christmas and anniversary gifts ₱6,000 a year.
Those five come to ₱60,800 a year per person, and none of it is reachable by a lump sum to an account. It needs a payroll to sit in. The same reasoning drives whether a Philippine entity is worth opening for two staff, and the answer turns on who runs the payroll.
December is when the gap stops being invisible
Section 2.79(B)(5)(b) sets out the annualised computation an employer runs at the year-end adjustment, in December or the final month. It is where a compliant payroll reconciles the year’s withholding against what was owed.
What happens when there is no payroll to reconcile?
The obligation moves to the individual. Your offshore team member may carry a filing position they do not know about, built on a year of gross receipts and nothing withheld. Australian super does not attach to a non-resident working outside Australia, as the rules on super for a Philippines hire set out. The Philippine obligation is separate, and in a direct arrangement nobody has discharged it.
The honest counter is that this is not your tax bill
It genuinely is not. The liability under the Philippine compensation table sits with the person earning, not with the Australian paying, and a properly structured contractor engagement is a real thing. This is a boundary question, not a trap, and any one engagement deserves proper advice.
What it does do is hand a compliant competitor a lever you do not have. Composing the same ₱80,000 so that ₱60,800 a year sits inside those exempt ceilings lifts that slice out of the 25 per cent bracket, worth up to about ₱15,200 a year to an employee on that payroll, at no extra cost to you. You spend the same and your person keeps less.

Price the person, not the transfer
Find out who is withholding on your Philippine salaries. One of three answers is true: a local payroll, a provider holding it, or nobody. If it is nobody, the arithmetic above is already running behind your retention.
Run one seat through a proper employment and the withholding, the annualisation and the de minimis structuring are somebody’s job. Or keep transferring, which is also a decision.
