Does The ATO Check My Super Payments Automatically? The Act Does Not Make Them Wait For You
Blake Manchester4 min read
Not automatically. Section 36 of the Superannuation Guarantee (Administration) Act 1992 lets the Commissioner make an assessment of an employer’s superannuation guarantee shortfall “at any time”, and subsection 36(2)(b) allows it “on the Commissioner’s own initiative”. Nothing has to be lodged by you first. Subsection 36(4) then makes the charge payable on the day the assessment is made.
Most Australian founders still picture super as a quarterly job. It has been a seven business day clock since 1 July.
Disclosure: Outstaffer sells an employer of record. It changes who employs a person abroad, and with it which country’s payroll clock you are on. It does nothing for the Australian staff on your own payroll, who are the subject here.
Payday Super made every payday a deadline
Under section 17A the day you pay qualifying earnings is a QE day, and the charge percentage in subsection 17A(2) is 12. The usual period in section 6 ends on the seventh business day after that QE day. Miss it and a shortfall exists. There is no quarter to tidy up in.
What actually triggers a Commissioner-initiated assessment?
The Act names no trigger. Subsection 36(1) says “at any time” and stops there. Draft PS LA 2026/D4, published on 16 October 2026, is titled Making Commissioner-initiated assessments: section 36 of the Superannuation Guarantee Administration Act 1992, and it replaces PS LA 2007/10 for anything after 30 June 2026. Comments close on 13 November.
What a 60 per cent uplift does to one missed pay run
Section 19B(1) sets the administrative uplift at 60 per cent of your shortfalls plus your notional earnings components. It is not a penalty you argue down afterwards. Paragraph 16B(2)(c) makes it part of the shortfall itself.
Run it. A thirty-person business pays $120,000 of qualifying earnings in a fortnightly run and the contribution never reaches the fund. The shortfall at 12 per cent is $14,400. The uplift adds $8,640 before notional earnings are counted at all. That is $23,040 against one pay run, payable the day the assessment lands, on $14,400 of super that never arrived.
Four missed pay runs, $92,160.
A voluntary disclosure does not stay voluntary
Section 33 says you may lodge a voluntary disclosure statement, and the note under subsection 33(2) says lodging one in the approved form can reduce the uplift. But paragraph 33(2)(a) only counts a statement as voluntary if it is lodged before the day an assessment is made.
Subsection 19B(3) spells out what the regulations may hang a reduction on, and the first item is whether the Commissioner has already assessed on the Commissioner’s own initiative.
When does the window close?
When the Commissioner decides, not when you do. The lever you control disappears the moment that happens. Subsection 37(2) then allows four years to amend that assessment where charge has been avoided, and no limit at all where the avoidance is put down to fraud or evasion.
Where Australian payroll and an offshore team sit in different systems, the reconciliation nobody owns is where this starts. We have written about the people who quietly fall out of a payroll report, and about why an Australian super bill does not follow a Manila hire.
The counter-argument is enforcement capacity, and it is fair
The ATO itself says publishing the draft does not change its compliance approach in the first year of Payday Super. A power that exists on paper is not one used against every employer who runs a day late. Nobody should write a cheque fearing a letter that may never arrive.
That is an argument about how often this happens, not about what it costs when it does. The amount does not shrink while nobody looks, the amendment window runs quietly, and the reduction you might have claimed closes with it.

None of this is advice on your situation, and super turns on facts a blog post cannot see, so get it checked.
Run the reconciliation this week rather than next quarter. If you are also carrying people abroad, sign up and put one role through it and that side is employed properly from day one. The Australian side stays yours. Or wait and find out whether the first you hear about your super payments is an assessment.
